N. Pyle to Reinhardt

This deed of trust made and entered into this 3 day of January 1854 between Nicholas Pyle of the 1st part and George M Duke and Ephraim A. Reinhardt of the second part.  Witnesseth that the said second party is about to become the securities for the personal appearance of the two infant sons of the said 1st party of Nicholas Pyle and John H. Pyle at the next term of the Circuit Court of Shelby County Alabama to answer the state of Alabama for an assault & Battery to commit murder on the body of James Harding.  Each of said bonds to be for the sum of five hundred dollars, and where as said Nicholas Pyle the 1st party is anxious & desirous to hold said securities harmless therefore for and in consideration of the promises as well the consideration of ten dollars to him in hand paid by said 2nd party said 1st party has given granted bargained and sold to said 2nd party the following property to wit.  One yoke of oxen 7 years old, one yoke of young oxen, 5 years old, five cows and four yearlings, ten pork hogs, thirty head of stock hogs, twenty five head of sheep, four feather beds and bed clothing to each one, ox cart & the eighty acres of land the same on which said Nicholas Pyle now lives to have and to hold said property & land forever in trust however and this conveyance is to be void & of in effect if said Nicholas Pyle & John H. Pyle appears at said circuit court and answers to said charge so as to discharge said securities but if said Nicholas & John H. Pyle or either of them shall fail to attend said court and a forfeiture is taken on said bond then said securities of either of them or their representatives may seize said property and sell the same at publick (sic) sale 1st giving ten days notice by advertisement in three publick (sic) places of the time and place of said sale for cash and out of said sale pay said forfeitures as forfeitures & costs and if anything is left after paying the same is to be paid over to said Pyle.  Witness our hand and seals day and year aforesaid.

Before the undersigned judge of Probate in and for the said County personally came the within named parties who are known to me.  And acknowledged before me on this day that being informed of the contents of the foregoing conveyance they executed the same voluntarily on the day the same bears date.  Given under my hand and seale this 3 day of January AD 1852.
