Pyle to Wheeler Sept 24, 1855

This indenture made and entered into this 24 day of Sept. A.D. 1855 between Nicholas Pyle of the Shelby County Alabama of the first part and R. J. Wheeler of the same state and county of the second part. Witnesseth that I said N. Pyle for and in consideration of the sum of one hundred & 15/100 dollars to use in hand paid the receipt whereof is hereby acknowledge have bargained sold and delivered and by these presents do grant bargain sell and deliver unto the said R. J. Wheeler his heirs a certain tract of piece of land known as the SE SE ¼ of SE ¼ & the SE ¼ of NE ¼ & the NE ¼ of the SE ¼ of Sec No 33 T 18 R2E in the district of Tuscaloosa & state of Ala containing one hundred and twenty acres more or less to him the said Wheeler his heirs and assigns to have and to hold the above described land and premises with all the appurtinances thereunto belonging or in any wise appertaining and the said party of the first and myself my heirs, executors admin and assigns to warrant secure and forever defend the rights of the aforesaid land to the said Wheeler his heirs and assigns against the claim of the United States and the claim of all manner of persons whatsoever claiming through by or under the same whether in law or equity in witness whereof I have hereunto set my hand and seal this date above written.

The foregoing deed of conveyance is on this express condition viz that should the said Nicholas Pyle by the first day of January 1857 pay to said R. J. Wheeler the sum of one hundred and 15/100 dollars good and lawful money with interest added thereon at eight percent per annum then the above conveyance to be null and void to all intents and purposes but should the said Pyle fail to pay the aforesaid amount to said Wheeler by the said stipulated time then the right of as to the aforesaid premisis  vests in said Wheeler absolutely and I the said N Pyle bind myself to put him (Wheeler) in [infreasable] and actual [propession?] of the same without any suit [prauss?] or hinderance whatever witnessed by my hand and seal this 24 day of September AD 1855,

I John C. Hannah, a Justice of the Peace for said county truly certify that Nicholas Pyle whose name is signed to the foregoing conveyance and who is known to me acknowledges before me on this day that being informed of the contents of the conveyance, he executed the same voluntarily on the day the [xxxxxxxxx]date for the purpose and condition therein contained given under my hand and seal this 24 day of AD 1855.
