Blount County

Be it Remembered that a regular term of the Honorable Probate Court was begun and held for the Western Division of said county at the court house at Bangor on the fourth Monday in November, it being the twenty seventh day of said month in the year of our Lord one thousand eight hundred and ninety-nine.  Present, the Honorable Tyre H. Davidson, Judge of Probate of said county.  At which term of said court the following proceedings were held to wit:

Application to Sell Lands

December 12, 1899

 

And now on this day comes J. F. McNeal the admin to this court his application in writing and under oath praying for an order to sell certain lands herein - after described for the purpose of making an equitable division and distribution among the heirs and distributees of said estate and alleging that said lands can not be equitably divided among the heirs and distributees without a sale thereof which said lands are described as follows to wit:  The South West ¼ of N. W. ¼ of Sec 3, T. 14 R. 4 West; Also E ½ of S.W. ¼ of N. W. ¼ of Sec 3, T. 14 R. 4 West containing 60 acres more or less in Blount county Alabama.  And also the East half of South East ¼; and thirty (30) acres on the East end of S.W. ¼ of S.E. ¼, Section 2, T. 15 Range 4 West in Jefferson County, Alabama, and containing in all one hundred and ten acres (110) more or less.  And said petitioner further represents that the names, ages, residence and conditions of the heirs and distributees are as follows, Viz:  Gus. Pyles over 21 years of age and resides in St. Clair County, Alabama; Sallie Cates, wife of James Cates both of full age and reside in Jefferson County, Alabama; William Pyles and Dan Pyles of full age and reside in the State of Mississippi; Sulla Pyles resides at Chasta Texas (?) and Eliza Pyles resides in Blount County, Alabama;     [Martha - see note]     Fulmer wife of James Fulmer residence unknown, and the heirs of Nick Pyles, deceased, to wit:  Henry Pyles, Eb. Pyles, Dock Pyles, Mary Pyles, and Alice Pyles who reside somewhere in the State of Mississippi, and all of said heirs and distributees are over the age of twenty-one years.  And the court having examined said petitions, it is ordered that the same be filed and that the 26 day of February 1900 be appointed a day for hearing said petition.  And that Gus. Pyles, Sallie Cates and her husband James Cates and Eliza Pyles, adult heirs and distributees residing in this state have notice of filing of said application and of the day above set for hearing by citations to the issued and served upon each of these not less than ten days before this day above set for hearing.

 

And it is further ordered that to the said William Pyles and Dan Pyles, Sulla Pyles,     [Martha - see note]     Fulmer wife of James Fulmer and the heirs of Nick Pyles deceased to wit:  Henry Pyles, Eb. Pyles, Mary Pyles, Alice Pyles and Dock Pyles, adult heirs and distributees residing out of this state be notified of said application and of the day set for hearing the same by publications of a notice to item directed once a week for three successive weeks before said 26 day of February in Hanceville Hustler, a newspaper published in said Blount County.

 

Note:  There is a pronounced blank in the document for the unknown first name of Martha Fulmer.
